For reasons that will become clear, we are going back to the very basics of procurement law: why does it exist? We study the case of TenderNed, highlighting risks caused by ICT procurement laws and regulations. Should we separate the procurement from the maintenance? Should we indeed procure ICT maintenance separately? Or not? From the perspective of years of experience in government ICT procurement, and with objective academic distance, we take a look at recommendations for a possible better future of ICT procurement in The Netherlands.
